Parkdale Properties in Toronto Ban Electric Vehicles, Citing Lithium Battery Risks

Oberon Development Corporation, a real estate company with properties in Toronto’s Parkdale neighborhood, has imposed a ban on the use of electric vehicles within its premises. Notices were prominently posted at 110 and 120 Jameson Ave., explicitly stating that electric transportation vehicles, including e-bikes, scooters, motorbikes, hoverboards, and more, are strictly prohibited anywhere on the property, encompassing apartments, garages, parking spaces, and lockers.

The notice cites concerns over fire hazards associated with lithium batteries as the primary reason for this ban. The City of Toronto had previously banned e-scooters in 2021, but their use has continued despite the prohibition. Toronto Fire Services reported responding to ten fires related to lithium-ion batteries in residential high-rises this year. They clarified that condo corporations are within their rights to establish rules for their buildings, a domain separate from their intervention.

However, renters residing in these affected buildings may have recourse under the Residential Tenancies Act, as the ban could potentially infringe on their right to the “reasonable enjoyment” of the premises. Additionally, individuals who rely on electric vehicles for health or mobility reasons may also challenge the ban, arguing that it infringes on their human rights.

Lithium-ion batteries, commonly found in various consumer electronics, can be safe to use but become hazardous under certain conditions due to their volatility. Transport Canada warns against using substandard or counterfeit batteries, exposing them to extreme temperatures, overcharging, or using non-certified chargers. Specific surface areas that trap heat, like couches or beds, should also be avoided for charging.

The ban imposed by Oberon Development Corporation reflects growing concerns about the safety of electric vehicles and lithium batteries in residential properties. While it seeks to address potential fire hazards, it has raised questions about tenant rights and access to essential mobility solutions for those who rely on electric vehicles.
