A draft executive order reportedly circulating in Washington has ignited debate over whether to classify illicit fentanyl as a weapon of mass destruction.
According to a copy of the alleged draft reviewed by multiple sources, the executive order declares “illicit fentanyl to be a Weapon of Mass Destruction as defined in 50 U.S.C. Section 2902.”
The language suggests that the administration is treating illegal fentanyl—a powerful synthetic opioid primarily produced abroad—as a threat to national security on par with chemical or biological weapons.

An observer, however, noted that the draft does “specify ‘illegal’ fentanyl as a WMD & not pharmaceutical company manufactured fentanyl which has numerous valid medical uses.”
Should this order go into effect, the Attorney General and the Secretary of Homeland Security would be tasked with devising rapid “operational recommendations” to implement the directive. Citing the president’s “highest duty” of national defense, the draft text calls for swift action to halt what the administration calls a “national emergency” tied to opioid overdose deaths.
Citing the president’s previous stance on border security and drug trafficking, one of the draft’s critics remarked that “if this EO is implemented it would also have drastic effects domestically,” noting that possession of fentanyl could conceivably be treated as possession of a WMD under certain interpretations of the law.
Heightening the stakes is a recent precedent in which the administration justified the deportation of hundreds of Venezuelan migrants by alleging membership in a newly-designated terrorist organization. The drug trafficking of fentanyl across US borders has also been President Donald Trump’s sticking point in justifying waging tariff wars against Canada and Mexico.
This is, however, not new. In 2022, Florida Attorney General Ashley Moody led a bipartisan group urging the White House to treat fentanyl as a WMD, and in 2024, Rep. Lauren Boebert introduced a bill supporting the measure.
